Licence and the Apple EULA

Jester Hex is licensed, not sold, to you. Unless JesterMedia has given you a separate written licence, your use of the app is governed by Apple's Standard End User License Agreement, which is available in full at apple.com/legal/internet-services/itunes/dev/stdeula/. Where these terms and that agreement differ on the scope of your licence, Apple's agreement governs.

Under that licence you get a personal, non-transferable right to use the app on Apple devices you own or control, as permitted by the App Store Usage Rules. You may not sell, rent, sublicense, redistribute, reverse engineer, or attempt to extract the source code or the puzzle data from the app, except where that restriction is prohibited by law.

What the game costs

Jester Hex is free to download and free to play through all 6,000 levels. It contains no purchases. It is funded by advertising, described below and in the privacy policy.

Advertising

The game shows a banner on the home screen and an occasional full-screen break between levels. It also offers reward videos, which are always optional: watching one to completion grants a power-up, and declining one never blocks your progress through the game. Ads are supplied by Google AdMob together with its mediation partners, and JesterMedia does not control which specific advertisement you are shown. Interfering with ad delivery, or using tools to fake ad completions or rewards, is a breach of these terms.

Power-ups, rewards, and progress

Hints, hammers, bombs, streaks, and completed levels are entries in a save file on your device. They have no monetary value, cannot be bought, sold, transferred, redeemed, or exchanged for anything outside the game, and are not your property. JesterMedia may change how rewards are earned or how many a level awards in a future version.

Progress is stored only on your device. There is no cloud sync, no account, and no restore. If you delete the app, change devices, or lose the device, your progress is gone and JesterMedia cannot recover it.

Acceptable use

Please do not modify the app, tamper with its save file to manufacture rewards, use automated tools to play it, or attempt to disrupt the services it relies on. We may stop providing the app, or a part of it, to anyone doing so.

Availability and changes

JesterMedia may update, change, or discontinue Jester Hex or any of its features at any time. Features that need a connection — advertising and analytics — depend on third-party services and are not guaranteed to be available. Every puzzle plays offline and does not depend on those services.

Disclaimer of warranties

To the fullest extent permitted by law, Jester Hex is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. JesterMedia does not warrant that the app will be uninterrupted, error free, or free of harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

Limitation of liability

To the fullest extent permitted by law, JesterMedia will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost data or lost game progress, arising out of or relating to your use of Jester Hex. Where liability cannot be excluded, it is limited to the amount you paid for the app, which for Jester Hex is nothing. Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

Children

Jester Hex is not directed to children under 13. If you are under the age of majority where you live, please only use the app with the involvement of a parent or guardian.

Governing law

These terms are governed by the laws of the United States and of the State of Ohio, without regard to conflict of law rules, except where the law of your country of residence requires otherwise. Any consumer rights you have under local law are unaffected.

Changes to these terms

If these terms change we will update the date at the top of this page. Continuing to use the app after a change means you accept the revised terms.
