These Terms of Use ("Terms") govern your access to and use of apps, websites, web tools, books, support pages, and other products ("Services") published under the registered DBA JesterMedia ("we," "us," or "our"). By downloading, installing, accessing, or using any JesterMedia Service, you agree to these Terms.
You must be legally able to agree to these Terms. If you are a minor, a parent or legal guardian must authorize your use. Account and community features require you to meet the age requirements stated for that product, including any applicable minimum age of consent. Product-specific eligibility rules apply. Product-specific terms govern their subject matter if they conflict with these general terms. Mandatory store terms and rights that cannot legally be excluded still apply. Signed web-design or other service agreements govern those client engagements. The press kit gives the permissions stated there for supplied JesterMedia press materials.
Merch purchases take place in a Printful Quick Store. Printful handles checkout, fulfillment, and order support under the terms shown in its store. For order questions, use the Contact link in the Printful store footer. Nothing here limits mandatory consumer rights.
JesterMedia grants you a limited, non-exclusive, non-transferable, revocable license to use our Services for lawful purposes within each product’s scope. Our free browser tools may be used for personal or commercial projects when you have the rights to the material you process. App-specific license limits still apply. You may not:
Some JesterMedia apps may offer optional subscriptions or paid features through the Apple App Store or Google Play. Product pages and in-app purchase screens identify the current features and pricing before purchase.
Example subscription terms
Payment is charged to the store account used at confirmation of purchase. Subscriptions renew automatically until canceled through the store used to purchase. For Apple subscriptions, turn off auto-renew at least 24 hours before the current period ends; Google Play shows the next billing date and cancellation details in your account. You can manage or cancel subscriptions through App Store or Google Play subscription settings.
Some JesterMedia apps allow or require account creation, guest profiles, household sharing, saved preferences, or cloud sync. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account. Where an app provides account deletion, you may use that feature or contact support for help.

All content in JesterMedia apps — including but not limited to design, code, text, graphics, logos, and app names — is the property of JesterMedia or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
To the extent permitted by applicable law, our Services are provided "as is" and "as available" without warranties of any kind, express or implied. JesterMedia does not warrant that our Services will be uninterrupted, error-free, or free of harmful components. Your use of our Services is at your sole risk.
To the maximum extent permitted by applicable law, JesterMedia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
JesterMedia's apps may be distributed through the Apple App Store and Google Play. These Terms are between you and JesterMedia, not Apple or Google. Apple and Google are not responsible for our apps or their content. To the extent these Terms conflict with applicable store terms, the store terms govern.

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
Nothing in these Terms excludes rights or liability that cannot lawfully be excluded. Updates will be notified as required by law; continued browsing is not a substitute for consent where express consent is required.
