These Terms of Use ("Terms") govern your access to and use of Jester's Gambit ("the App"), published by JesterMedia LLC ("JesterMedia," "we," "us," or "our"). By downloading, installing, or using Jester's Gambit, you agree to these Terms. If you do not agree, do not use the App.
By using Jester's Gambit you confirm that you are at least 13 years of age (or the minimum age of digital consent in your jurisdiction), that you have read and understood these Terms, and that you agree to be bound by them.
JesterMedia grants you a limited, non-exclusive, non-transferable, revocable license to download and use Jester's Gambit for personal, non-commercial purposes. You may not:
Jester's Gambit offers an optional premium subscription, Jester's Gambit Pro. The following terms apply:
Jester's Gambit Pro Subscription Plans
Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage or cancel your subscription in the App Store: Settings → Apple ID → Subscriptions.
Pro benefits include: removal of all ads, unlimited hints across all 9 games, access to the 30-day puzzle archive, and full stats history. Benefits are tied to your Apple ID and can be restored on any device signed in to the same Apple ID via the Restore Purchases option in the App.
Jester's Gambit allows optional account creation via Apple Sign In, Google Sign In, or Email/Password. You may also play as a guest without creating an account.
Jester's Gambit allows users to set a public username visible on the leaderboard. You agree that your username will not:
JesterMedia reserves the right to change or remove any username that violates these guidelines.
You agree not to use Jester's Gambit to:
All daily puzzles in Jester's Gambit are generated and owned by JesterMedia LLC. Puzzles are refreshed daily and are not reproduced, distributed, or shared outside the App without written permission from JesterMedia.
All content in Jester's Gambit — including but not limited to design, code, text, graphics, logos, game mechanics, and puzzle content — is the property of JesterMedia LLC or its licensors and is protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
Jester's Gambit is provided "as is" and "as available" without warranties of any kind, express or implied. JesterMedia does not warrant that the App will be uninterrupted, error-free, or that daily puzzles will always be available. Your use of the App is at your sole risk.
To the maximum extent permitted by applicable law, JesterMedia LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Jester's Gambit. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
Jester's Gambit is distributed through the Apple App Store. These Terms are between you and JesterMedia LLC, not Apple. Apple is not responsible for the App or its content. To the extent these Terms conflict with Apple's App Store Terms of Service, Apple's terms govern. Apple has no obligation to provide maintenance or support for the App.
Jester's Gambit uses the Apple Standard End User License Agreement (EULA): apple.com/legal/internet-services/itunes/dev/stdeula/
Your use of Jester's Gambit is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We may update these Terms from time to time. We will post the updated Terms here and revise the "Last Updated" date. Your continued use of Jester's Gambit after any changes constitutes your acceptance of the updated Terms.
We reserve the right to suspend or terminate your access to Jester's Gambit at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions.
